Comments are in responding DOL RFI on various Pooled Employer Plans (PEPs) structures and the need for prohibited transaction exemptions. The commentators, including TAG Resources, all agreed on the use of PEPs to improve coverage, but differed on recommendations for PTEs to permit specific structures. It is hoped that in any new guidance, DOL avoid imposing overly prescriptive conditions or increasing complexity that could unnecessarily reduce innovation and fair competition without any additional protection to plan participants – doing so would detract from Congress’ goal in establishing PEPs to increase coverage through economies of scale and efficiencies in administration.
